B\u00f6ylece, say\u0131lar\u0131 1.5 milyona ula\u015fan KOB\u0130\u2019ler s\u00fcrekli i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rmak yerine, yo\u011fun olduklar\u0131 d\u00f6nemlerde 7.5 milyon ki\u015fiye kadar ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rabilecek.<\/p>\n<p>T\u00fcrkiye \u0130\u015f Kurumu\u2019nun (\u0130\u015eKUR) \u00d6zel \u0130stihdam B\u00fcrolar\u0131 Y\u00f6netmeli\u011fi\u2019ni yay\u0131mlamas\u0131yla, \u00e7al\u0131\u015fma hayat\u0131nda i\u015f\u00e7i kiralama d\u00f6nemi ba\u015flad\u0131. \u00c7al\u0131\u015fma hayat\u0131nda k\u00f6kl\u00fc de\u011fi\u015fiklik yapacak yeni d\u00fczenlemeye g\u00f6re, art\u0131k i\u015fyerlerinde toplam \u00e7al\u0131\u015fan say\u0131s\u0131n\u0131n y\u00fczde 25\u2019ine kadar ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131labilecek.<\/p>\n<p>S\u00fcrekli \u00e7al\u0131\u015fan i\u015f\u00e7i say\u0131s\u0131 10 veya daha az ki\u015fi olan i\u015fyerleri ise 5 i\u015f\u00e7iye kadar ge\u00e7ici i\u015f\u00e7i istihdam edebilecek. Bir i\u015f\u00e7isi olan i\u015fveren de 10 i\u015f\u00e7isi olan i\u015fveren de 5 ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rma hakk\u0131na sahip olacak. Sosyal G\u00fcvenlik Kurumu (SGK) verilerine g\u00f6re, T\u00fcrkiye\u2019de temmuz ay\u0131 itibar\u0131yla 1 milyon 712 bin i\u015fyeri bulunuyor.<\/p>\n<p>Bunlardan 1 milyon 468 bin i\u015fyerinde 9 veya daha az ki\u015fi \u00e7al\u0131\u015f\u0131yor. T\u00fcrkiye genelindeki 14 milyon 67 bin i\u015f\u00e7inin 3 milyon 958 bini 9 veya daha az i\u015f\u00e7isi bulunan i\u015fyerlerinde \u00e7al\u0131\u015f\u0131yor.<\/p>\n<p>Say\u0131lar\u0131 1.5 milyona ula\u015fan k\u00fc\u00e7\u00fck ve orta boy i\u015fletmeler (KOB\u0130), s\u00fcrekli i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rarak y\u0131l\u0131n 12 ay\u0131 personel \u00fccreti \u00f6demek yerine sadece i\u015flerinin yo\u011fun oldu\u011fu d\u00f6nemlerde ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rabilecek. Bu, KOB\u0130\u2019lere k\u0131dem tazminat\u0131 ve ihbar tazminat\u0131 gibi y\u00fck\u00fcml\u00fcl\u00fcklere katlanmadan i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rma olana\u011f\u0131 sa\u011flayacak.<\/p>\n<p>\u0130\u015f\u00e7i say\u0131s\u0131 10 ve alt\u0131ndaki i\u015fyerlerinin her biri 5 ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rma olana\u011f\u0131na sahip olaca\u011f\u0131ndan, KOB\u0130\u2019ler s\u00fcrekli \u00e7al\u0131\u015ft\u0131rmak zorunda olduklar\u0131 i\u015f\u00e7ilerin bir k\u0131sm\u0131n\u0131 at\u0131p 7.5 milyon ki\u015fiye kadar ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rabilecek.<\/p>\n<p>Yasaya g\u00f6re, ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rma konusunda her ne kadar do\u011fum ve anal\u0131k izni ile askerlik ve mevsimlik i\u015f\u00e7ilik gibi s\u0131n\u0131rlamalar varm\u0131\u015f gibi g\u00f6r\u00fcn\u00fcyorsa da \u201ci\u015fletmenin ortalama mal ve hizmet \u00fcretim kapasitesinin ge\u00e7ici i\u015f ili\u015fkisi kurulmas\u0131n\u0131 gerektirecek \u00f6l\u00e7\u00fcde \u2018\u00f6ng\u00f6r\u00fclemeyen\u2019 \u015fekilde artmas\u0131 halinde\u201d de ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131labilecek.<\/p>\n<p>\u201c\u00d6ng\u00f6r\u00fclemeyen\u201d ifadesinin, t\u00fcm KOB\u0130\u2019lerin diledikleri zaman ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rmalar\u0131na olanak sa\u011flayaca\u011f\u0131 belirtiliyor.<\/p>\n<p><strong>\u0130\u015eTEN \u00c7IKARAN 6 AY SONRA \u0130\u015e\u00c7\u0130 ALAB\u0130LECEK<\/strong><\/p>\n<p>Bir i\u015fveren s\u00fcrekli \u00e7al\u0131\u015fan i\u015f\u00e7isini i\u015ften \u00e7\u0131kard\u0131ktan 6 ay sonra ge\u00e7ici i\u015f\u00e7i i\u015fe alabilecek. Daha erken bir tarihte kiral\u0131k i\u015f\u00e7i almas\u0131 s\u00f6z konusu olamayacak.<\/p>\n<p><strong>\u00dcCRET\u0130NDEN GE\u00c7\u0130C\u0130 \u0130\u015e\u00c7\u0130 \u00c7ALI\u015eTIRANLAR DA SORUMLU<\/strong><\/p>\n<p>Ge\u00e7ici i\u015f\u00e7iler \u00fccretlerini, kendilerini ge\u00e7ici olarak \u00e7al\u0131\u015ft\u0131ran i\u015fverenlerden de\u011fil, \u00f6zel istihdam b\u00fcrosundan alacak. Ancak, ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren, i\u015f\u00e7inin \u00fccretinin \u00f6denip \u00f6denmedi\u011fini her ay kontrol edecek. \u00dccret \u00f6denmemi\u015fse, \u00f6zel istihdam b\u00fcrosunun alaca\u011f\u0131ndan mahsup etmek suretiyle i\u015f\u00e7inin paras\u0131n\u0131 do\u011frudan banka hesab\u0131na yat\u0131rabilecek.<\/p>\n<p>\u0130\u015fyerinde as\u0131l i\u015f\u00e7ilere tan\u0131nan yemek, ula\u015f\u0131m, kre\u015f gibi hizmetlerden ge\u00e7ici i\u015f\u00e7iler de yararlanacak. Ge\u00e7ici i\u015f\u00e7iler, \u00e7al\u0131\u015fmad\u0131klar\u0131 d\u00f6nemde ise \u00f6zel istihdam b\u00fcrosundaki e\u011fitim ve \u00e7ocuk bak\u0131m hizmetlerinden faydalanacak. Ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren, i\u015fyerine eleman alacaksa bu durumu ge\u00e7ici i\u015f\u00e7isine bildirmek zorunda olacak.<\/p>\n<p>Ge\u00e7ici i\u015f\u00e7iler, \u00f6zel istihdam b\u00fcrosundan talep olduk\u00e7a bir i\u015fte \u00e7al\u0131\u015fabilecek. \u00d6rne\u011fin A firmas\u0131nda 6 ay \u00e7al\u0131\u015fan bir i\u015f\u00e7inin yeniden bir i\u015fte \u00e7al\u0131\u015fabilmesi i\u00e7in ba\u015fka bir firmadan ge\u00e7ici i\u015f\u00e7i talebi olmas\u0131 gerekecek. Talep gelinceye kadar bekleyecek.<\/p>\n<p>Y\u00f6netmeli\u011fe g\u00f6re, ge\u00e7ici i\u015f\u00e7i ile \u00f6zel istihdam b\u00fcrosu aras\u0131nda yap\u0131lacak i\u015f s\u00f6zle\u015fmesinde, i\u015f\u00e7inin ne kadar s\u00fcrede i\u015fe \u00e7a\u011fr\u0131lmamas\u0131 durumunda s\u00f6zle\u015fmeyi \u201chakl\u0131 nedenle\u201d feshedebilece\u011fi belirtilecek. Belirlenecek s\u00fcre 3 ay\u0131 ge\u00e7emeyecek.<\/p>\n<p>Bu durumda, e\u011fer i\u015f\u00e7i \u00f6zel istihdam b\u00fcrosuna ba\u011fl\u0131 olarak en az 1 y\u0131l \u00e7al\u0131\u015fm\u0131\u015fsa, k\u0131dem tazminat\u0131 alabilecek.<\/p>\n<p>Fakat \u00f6zel istihdam b\u00fcrosu i\u015f\u00e7i ile imzalayaca\u011f\u0131 s\u00f6zle\u015fmeyi sadece ge\u00e7ici i\u015f\u00e7i talebi olan d\u00f6nemle s\u0131n\u0131rl\u0131 tutarsa, i\u015f\u00e7inin k\u0131dem tazminat\u0131 hakk\u0131 do\u011fmayacak. Y\u00f6netmelikte, bu konuda engelleyici bir h\u00fck\u00fcm bulunmuyor.<\/p>\n<p><strong>DO\u011eUM \u0130ZN\u0130 VE ASKERL\u0130K B\u0130TENE KADAR<\/strong><\/p>\n<p>Ge\u00e7ici i\u015f\u00e7iler, do\u011fum ve anal\u0131k iznine \u00e7\u0131kan kad\u0131n ile askere gidenler i\u015fe d\u00f6nene kadar \u00e7al\u0131\u015fabilecek.
